DISTANCE SALES CONTRACT

ARTICLE 1 – PARTIES
This Agreement has been concluded electronically between the parties whose information is given below, within the framework of the provisions of the Consumer Protection Law and the Distance Contracts Regulation.

ARTICLE 2 – SUBJECT OF THE CONTRACT
This Agreement is between the BUYER and the SELLER [ www.sapheen.com ] regulates the rights and obligations of the parties in accordance with the provisions of the Consumer Protection Law No. 6502 and the relevant Regulation regarding the sale and delivery of the product(s) ordered electronically through the website.

ARTICLE 3 – PRODUCT INFORMATION
The type, kind, quantity, color, price, payment method and delivery information of the products are chosen by the BUYER and declared during the order, and these information are included in the invoice and order summary document sent to the BUYER.

ARTICLE 4 – DELIVERY
4.1. Product(s) will be delivered to the address specified by the BUYER during the order via the cargo company.
4.2. Delivery time is 30 (thirty) days at the latest from the confirmation of the order.
4.3. The SELLER may extend the delivery period for a maximum of 10 days for justified reasons. This situation will be notified to the BUYER in writing or via permanent data storage.

ARTICLE 5 – RIGHT OF RETURN AND WITHDRAWAL
5.1. The BUYER has the right to withdraw from the contract within 14 (fourteen) days from the date of receipt of the product, without giving any reason and without paying any penalty.
5.2. In order to exercise the right of withdrawal, an e-mail or written notification must be sent to the SELLER within this period.
5.3. The product returned within the scope of the right of withdrawal must be unused, not lost its resalability, and sent with its packaging and invoice.
5.4. Return shipping costs belong to [seller/buyer].
5.5. Products that are not within the scope of the right of withdrawal (custom-made products, products that deteriorate quickly or have expired, products that are not suitable for return due to hygiene reasons, etc.) cannot be returned in accordance with Article 15 of the Distance Contracts Regulation.

ARTICLE 6 – PAYMENT
6.1. The product price specified at the time of ordering is collected via the selected payment method (credit card, debit card, money order/EFT, etc.).
6.2. In transactions made through intermediary payment institutions such as iyzico, the BUYER is deemed to have accepted the contract and security provisions of the institution in question at the time of payment.

ARTICLE 7 – GENERAL PROVISIONS
7.1. The BUYER accepts that he/she has read and is informed about the basic characteristics of the product, sales price, payment method, delivery information and right of withdrawal on the SELLER's website and has given the necessary confirmation electronically.
7.2. This Agreement shall enter into force as soon as it is approved electronically.

ARTICLE 8 – DISPUTE RESOLUTION
In the implementation of this Agreement, Provincial/District Consumer Arbitration Committees are authorized up to the value declared by the Ministry of Commerce, and Consumer Courts are authorized in disputes above this value.

ARTICLE 9 – ENFORCEMENT
By placing an order, the BUYER is deemed to have accepted all the terms of this contract.
